Wurstbude partly on private land, partly on public land

The popular Swakopmund Restaurant Wurstbude in the suburb Vineta is situated on Vrede Rede Avenue and infringes on a part of a public open space. This error in town planning came to light during the most recent Town Council meeting. Instead of deciding how to rectify the unfortunate situation Town Council sent the item back to be discussed by the next Management Committee meeting.

The unfortunate situation is explained in the Agenda of the Town Council meeting. According to the document Council appoin-ted a town planning consultant to undertake all required statutory procedures for the rectification of the General Plans for Vrede Rede Avenue. Reason for this is that the current situation differs quite considerably from the one depicted on the General Plan of Swakopmund.
Most notable in this case is the erven on which the Wurstbude is situated, which in actual fact is located right on the Avenue. “It is the intention of the Municipality to create erven to accommodate Wurstbude Restaurant as well as parking for the restaurants’ clients (sic),” it states in the Agenda.

While the Wurstbude is not formally situated on an erf, a part of the property is also infringing on a public open space.
On the General Plans of the town it actually indicates that one erf next to the Wurstbude was intended as a traffic island, but in reality a big part of the erf forms part of the current Vrede Rede Avenue. The same is true for another erf which forms part of First Avenue.
A similar situation has been identified for Scultetus Street in the same suburb. In this case it came to light that according to the current General Plan for Swakopmund, the so-called Jukskei Park is not located on an erf, but instead is also situated right on top of Scultetus Street.

“The Park totally envelopes Erf 89 and partially infringes on Erf 90. Whilst Erf 88 was intended as a traffic island, but in reality a big part of Erf 88 forms part of Jukskei Park, while the remainder of Erf 88 forms part of Scultetus Street,” it states in the Agenda.
Instead of deciding on a solution regarding this error in town planning, Council also sent this item back to be discussed at the next Management Committee meeting. Thereafter both items will once again be submitted to Town Council to take a decision going forward.
A similar error exists in Scultetus Street in the same suburb.
